Instructions have been filed by learned Standing Counsel. The same be taken on record.
The instructions reveal that no inquiry, as per the Government Order dated 29.7.2004, preceded the order dated 8.3.2019. A perusal of the order dated 8.3.2019 reveals that simply because of some inspection which reveals that the petitioner along with another Fair Price Shop dealer had indulged in some act which was not to the liking of the authorities, the license was cancelled.
Under such circumstances, the order dated 8.3.2019 passed by the District Supply Officer, Agra is set aside. The essential commodities shall continue to be distributed through the shop to which the shop of the petitioner was attached and an enquiry shall be initiated against the petitioner which shall be concluded within a period of one month from the date of its initiation.
The writ petition is, accordingly, allowed to the extent indicated above.
