The prayer made in the instant petition is for issuing direction to the court below to decide Misc. Case No. 67 of 2013 under Order 9 Rule 13 CPC within a specified time frame.
The case has been registered on the basis of application filed by the petitioner. A perusal of the order sheet reveals that the parties are contesting the proceedings and regular dates are being fixed, but the application under Order 9 Rule 13 CPC filed in the year 2013 has yet not been disposed of.
Accordingly, the petition is disposed of with direction to the trial court to decide Misc. Case. 67 of 2013 under Order 9 Rule 13 CPC expeditiously, by fixing short dates and without granting unnecessary adjournments, provided there is no legal impediment.
