Heard learned counsel for parties.
Although from the order sheet which is appended along with this petition it cannot be said that the suit proceedings have been unnecessarily delayed by the concerned Court, proceedings appear to have been stalled on account of a Miscellaneous Application in P.A. Case No. 17 of 2012 (Mukesh Chandra Bansal and Another Vs. Ghanshyam) which has been moved by the opposite parties. This application is still pending although it was filed as far back as on 6 August 2018.
In view of the aforesaid, the Court only observes that the Civil Judge (Senior Division)/Prescribed Authority, Firozabad before whom the aforesaid case is pending shall move in the matter with expedition and without granting any unnecessary adjournments to parties. All endeavour shall be made to dispose of the pending application with expedition and preferably within a period of four months from the date of presentation of a duly authenticated copy of this order subject of course to the roster of the concerned Court and pendency of older cases.
Petition stands disposed of.
