The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the injunction order dated 27.05.2013 passed by the trial court in Original Suit No. 351 of 2010.
It is argued that inspite of the interim injunction granted in favour of the plaintiff-petitioner, the opposite parties will destroy the crops of the applicant.
From perusal of the record it appears that the applicant has preferred the present petition for non compliance of the injunction granted in his favour by the trial court.
The Court is of the opinion that in case the applicant is aggrieved to the effect that interim order dated 27.05.2013 is not complied with the statutory remedy is available to the applicant to file an application before the court concerned as provided under Order 39 Rule 2-A read with section 151 of the Code of Civil Procedure.
In view of the same, the present petition is disposed of finally with a direction to the applicant, if so advised, to file such application before the concerned court below. In case, such an application is filed by the petitioner before the court below, the same shall be considered and decided in accordance with law expeditiously.
