Heard Sri Sanjay Mishra,learned counsel for the petitioner and learned AGA appearing for the State and also perused the record.
The instant petition has been filed by the petitioner with the prayer to set aside the impugned order dated 26.2.2019 passed by the learned A.C.J.M., Court No.1,Aligarh in Case No.1 of 2016, under section 31 of Domestic Violence Act, P.S.Kotwali, District Aligarh.
Submission of the learned counsel for the petitioner is that the trial court may be directed to consider and decide the criminal appeal pending before it within one month.
The prayer for setting aside the aforesaid impugned order is refused.
However, considering the facts and circumstances of the case and submission advanced by the learned counsel for the petitioner and without looking into the merits of the case, the court below is directed to consider and decide the criminal appeal no.45 of 2019 pending before it as early as early possible preferably within a period of one month from the date of production of certified copy of the order before it.
Till the disposal of the criminal appeal no.45 of 2019 the execution proceeding in the aforesaid case shall remain stayed against the petitioner.
With the aforesaid observation, the petition is finally disposed off.
