Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 229 of 2018, under Sections 452, 354, 376, 511 IPC and 7/8 Protection of Children from Sexual Offences Act (POCSO), P.S. Sadar Bazar, District Shahjahanpur, is seeking enlargement on bail during the trial.
Considering the fact that the prosecutrix is a minor girl aged about 8 years and she in her statement recorded under Section 161 Cr.P.C. has fully supported the prosecution case as spelt out in the FIR, the applicant is not entitled to be enlarged on bail at this stage. The prayer for bail is rejected.
Accordingly, the bail application of the applicant is hereby rejected.
