The first petitioner is the owner of lorry bearing registration No.KL-40-F-0846 and the second petitioner is owner of a JCB bearing registration No.KL-7-AZ-9160 have been seized alleging transportation of minor minerals without permit. Petitioners submit that the above vehicles were used for demolishing an old building and transporting building materials. Vehicles have not violated any provisions of the Kerala Minor Minerals Concession Rules 1967.
2. Considering the facts and circumstances, there shall be a direction to the respondent to release the petitioners vehicles on executing a simple bond. However, this will not stand in the way of respondent filing any complaint against the petitioners, if so warranted. Vehicles shall be released to the petitioners forthwith on executing simple bond.
The Writ Petition is disposed of as above.
