Muhammed U.P vs Perinthalmanna

High Court Of Kerala|07 November, 2014
|

JUDGMENT / ORDER

The petitioner has filed this writ petition challenging Ext.P5 proceedings of the respondent by which an application for building permit has been rejected. I notice that Ext.P5 is a considered order passed after inspection of the site and recording the statements of interested persons. It has been found that the property belongs to the category of paddy field. The petitioner has a statutory remedy against Ext.P5, which he has not exhausted. Therefore I am not inclined to entertain this writ petition.
In view of the above, this writ petition is dismissed, without prejudice to the statutory remedies available to the petitioner against Ext.P5.
