JUDGMENT / ORDER

This application for anticipatory bail is preferred under Section 438 of the Cr.P.C. by accused Nos.1 to 3 in Crime No.485/2014 of the Nattukal Police Station, Palakkad. The offences alleged against them are under Sections 294(b), 341 and 354(A) of IPC. When the above said application for anticipatory bail was taken up for consideration, the learned Public Prosecutor would submit, on instructions, that all the aforementioned offences registered against the petitioners in the aforementioned crime No.485/2014 are bailable offences and that it is for the petitioners to seek their remedy elsewhere, since the invocation of the remedy under Section 438 Cr.P.C. is exclusively for non-bailable offences. Accordingly, this application for anticipatory bail is closed granting liberty to the petitioners to invoke the appropriate remedy, in accordance with law.
