The revision petitioner has obtained an order from the Judicial First Class Magistrate Court, Malappuram under Section 457 of the Code of Criminal Procedure for release of his goods vehicle bearing Registration No.KL-8B-6635 on certain conditions including a condition to deposit ₹ 30,000/- and another condition to produce Bank Guarantee for ₹ 40,000/-. 2. Aggrieved by the conditions, he has approached this Court with this revision. The learned counsel for the revision petitioner submitted that such stringent conditions are not necessary when the law stands amended. Of course, it is true that release of vehicle can be ordered on appropriate conditions. It is for the Court to decide what all would be the appropriate conditions in a particular case. Of course, in this particular case, I feel that the direction to deposit ₹ 30,000/- will ensure production of the vehicle as and when required, when there is another direction to execute bond for ₹ 70,000/-. In such a situation,the third condition to produce Bank Guarantee for ₹ 40,000/- is not necessary and the said condition can be cancelled. With such a modification, this revision can be closed.
In the result, this revision petition is closed with a modification in the impugned order of the trial court that the third condition imposed by the trial court directing production of Bank Guarantee will stand cancelled.
