JUDGMENT / ORDER

The petitioner is the holder of permit for quarrying. The petitioner wants to remove top soil from the quarrying area. The petitioner relies on Ext.P3 judgment. This Court in Ext.P3 judgment held that without insisting for No Objection Certificate or Environment Clearance Certificate, ‘P form’ shall be issued to the petitioner for transporting the top soil.
Therefore, after ascertaining the top soil to be removed from the area mentioned in Ext.P1, necessary ‘P form’ shall be issued to the petitioner without insisting for No Objection Certificate or Environment Clearance Certificate. It is also made clear that the Geologist shall also not insist for filling up the pit by using top soil so removed. Needful shall be done within a period of two weeks.
The writ petition is disposed of as above.
