Petitioner submits that he is entitled to construct a residential building in resurvey No.K-413/5B of Kattiparuthi Village, Tirur Taluk. Petitioner has approached the District Geologist for issuance of P-form.
In view of the Government Order, no permission is required for extracting ordinary earth from the site covered by building permit. However, for the purpose of transporting ordinary earth, P- form is required from the Geologist. Therefore, the petitioner shall produce necessary authorisation from the local authority to show that he has given permission to the construction of residential building. Thereafter the Geologist shall issue necessary 'P'-form on being satisfied with the genuineness of the claim of the petitioner based on building permit without insisting for No Objection Certificate. However, if the petitioner, after removing ordinary earth from the site, failed to construct any residential building, in the circumstance, the Geologist shall initiate necessary action against the petitioner for contravening the provision. Petitioner shall approach the Geologist along with permit from any local W.P(C).No.29272 of 2014 H 2 authority with an application for P-form. Needful shall be done on receipt of such application along with permit from the local authority within a period of ten days from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of as above.
