Petitions filed under Section 438 Cr.P.C. 2. Petitioner is the 1st accused in Crime No.1323 of 2014 of Tirur Police Station, which is the subject matter of B.A.No.8214 of 2014. The very same petitioner is the 1st accused in Crime No.1338 of 2014 of Tirur Police Station, which is the subject matter of B.A.No.8360 of 2014.
3. The allegation against the petitioner is that in the said two cases, he obtained three vehicles by agreeing that he would sell it to somebody in Pattambi area and would hand over the sale consideration to the respective persons who had entrusted the vehicles. Thereafter, the petitioner has cheated those persons by fraudulently pledging the vehicles in Karnataka and without paying sale consideration to the persons from whom the vehicles were obtained by him.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor.
5. The contents of the CD prima facie reveal the complicity of the petitioner. It seems that the two vehicles out of the three vehicles were recovered and seized from Bangalore. One of the vehicles is yet to be recovered. The investigation of these cases are not over. The allegations against the petitioner are very grave and serious. Considering the seriousness of the allegations against the petitioner and the present stage of the investigation, I do not think that these are not fit cases wherein anticipatory bail can be granted to the petitioner.
In the result, these bail applications are dismissed.
