JUDGMENT / ORDER

Petitioner is the first accused in Crime No.523 of 2014 of the Kasaragod Police Station for the offences punishable under Sections 511 of 364, 115, 118, 120(b) of the Indian Penal Code, is in custody from 27.05.2014 and seeks bail.
2. Learned Public Prosecutor has opposed the application. It is submitted that one Ashraf complained to the Dy.S.P. about threat to his life. The Dy.S.P engaged shadow Police to pose themselves as quotation team. The petitioner along with accused 2 and 3 engaged into criminal conspiracy. The petitioner, on 27.05.2014 handed over Rs.10,000/- by way of advance. Some of the accused are yet to be arrested.
3. Learned counsel submits that the allegations are not true and are quite unbelievable. It is also submitted that the case is that Rs.10,000/- was handed over to the shadow Police and not to the quotation team.
4. Since investigation is in the preliminary stage and some of the accused are yet to be arrested, request for bail B.A.No.4365 of 2014 2 cannot be allowed at this stage.
Application is dismissed without prejudice to the petitioner moving again after the investigation has progressed.
