THE HON’BLE SRI JUSTICE R.KANTHA RAO CIVIL REVISION PETITION NO.1361 OF 2014 ORDER Heard the learned counsel appearing for the revision petitioner.
In a suit for specific performance, the petitioner filed an Interlocutory Application, seeking temporary injunction ex parte, directing the respondents not to alienate the properties.
It seems that the learned trial Court issued notice and receiving the same, the respondents entered appearance.
The learned counsel appearing for the revision petitioner submits that the trial Court ought to have granted ex parte injunction having regard to the material placed before it. The learned counsel would further submit that in spite of the appearance made by the respondents, the trial Court is not making any endeavour to dispose of the application filed for grant of temporary injunction.
In the above circumstances, the Civil Revision Petition is disposed of directing the trial Court to hear and dispose of the application filed for grant of temporary injunction within a period of 30 days from the date of receipt of copy of this order. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
