ORDER:
Heard learned Counsel for the petitioner and learned Counsel appearing for Respondents 3 and 4.
This Writ Petition was filed challenging action of the second respondent in interfering with the petitioner’s peaceful possession and enjoyment of the shopping complex bearing D.Nos.3/32, 3/33, 3/34 & 3/35 of Main Bazar, Porumamilla village & Mandal, kadapa District.
This Court by order dated 01.05.2007 observed that on a requisition made either by the bailiff or on the order of the Executing Court, it is always open for the second respondent to give aid to the decree holder as well as the bailiff, but without there being any requisition either by the bailiff or on the order from the Court, the police shall not interfere with the peaceful possession and enjoyment of the petitioner.
The learned Counsel for the petitioner submits that in view of the aforesaid interim order, no further orders are required to be passed in the present Writ Petition.
Recording the said statement of the learned Counsel for the petitioner, the Writ Petition is closed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
