In terms of order dated 29.5.2017 in Writ C No. 24268 of 2017, the Collector, Banda and Managing Director, UPSIDC were required to take final decision on the request made by the applicant for acquisition of his plot for which no passage was left on account of acquisition of adjoining land. The decision was required to be taken within six weeks from the date of production of certified copy of the order.
It is evident from the material placed on record that District Magistrate, Banda as well as the State Government had written several letters to the Managing Director, UPSIDC to take appropriate action, but nothing has been done.
This Court is of the opinion that before inaction on part of the opposite party in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order along with fresh representation before the opposite party and in which event, he shall ensure that compliance of the direction issued by the Writ Court is made within next four weeks. In case the compliance is still not made, as directed herein, it shall be open to the applicant to initiate fresh contempt proceedings against the opposite party.
