This Writ Petition is filed for a mandamus to set-aside Memo No.Licence-2/L1/2014-1, dated 5-9-2014 of respondent No.2 whereby he has returned the petitioner’s application for renewal of Repairing Licence on the following alleged lapses :
1. Rental Agreement Deed is not renewed.
2. Municipal Trade License not renewed.
3. Original Skilled Worker certificate of Sri Syed Ahmed Ghouse Mohiddin not enclosed.
4. Labour Registration Certificate not furnished.
Further, the request of the petitioner for change of Skilled Worker was not entertained.
Sri Kowturu Vinaya Kumar, learned Counsel for the petitioner, submitted that while his client is prepared to comply with the alleged lapses pointed out in Sl.Nos.1 to 4 supra, the petitioner is only aggrieved by the communication of respondent No.2 to the effect that the request for change of Skilled Worker cannot be accepted.
Today, I have disposed of W.P.No.35798 of 2014 holding that a licensee is entitled for substitution of Skilled Worker. In view of the said order, respondent No.2 is directed to reconsider the petitioner’s application for renewal of license subject to the petitioner rectifying the lapses mentioned at Sl.Nos.1 to 4 supra in the impugned order. Respondent No.2 is also directed to allow substitution of Skilled Worker subject to his fulfilling the prescribed qualifications. An appropriate order after such reconsideration of the petitioner’s application shall be passed within a period of one week from the date of receipt of this order.
Subject to the above directions, the Writ Petition is allowed.
As a sequel to the disposal of the Writ Petition, WPMP No.40330 of 2014 filed for interim relief is disposed of as infructuous.
