Petitioner was appointed as Mutawalli vide order dated 23.03.2011 by the U.P. Sunni Central Waqf Board for a period of three years. Admittedly, the said period of three years has expired. Petitioner is aggrieved by appointment of respondent no.4 as Mutawalli.
A large number of argument has been raised by learned counsel for the petitioner including that only one member has passed the order appointing the respondent no.4 as Mutawalli whereas the requirement is that it should have been passed by the Waqf Board.
Be that as it may, since the petitioner has efficacious alternative remedy by filing an appeal before the Tribunal, we are not inclined to interfere in this matter at this stage.
The writ petition stands dismissed relegating the petitioner to avail the alternative remedy under the statute in case if so advised.
