M.Thangeswaran vs The Deputy Superintendent Of ...

Madras High Court|06 February, 2017

JUDGMENT / ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to call for records relating to the impugned order dated 31.01.2017 passed by the first respondent and quash the same and also to direct the respondents to give necessary permission for conducting Orchestra on 20.02.2017 in the place mentioned in the petition, by way of issuing a writ of certiorarified mandamus.
2.Mr.M.Govindan, learned Special Government Pleader, has taken notice for the respondents.
3.It is seen from the records that a representation has been given by the petitioner for getting necessary permission to conduct Orchestra on 20.02.2017 and the same has been rejected by the first respondent simply on the ground of law and order problem by way of passing the impugned order and the same is being challenged in the present writ petition.
4.Considering the fact that the representation in question has been given only for conducting Orchestra on 20.02.2017 and also considering that the first respondent has simply rejected the same on the ground of law and order problem, this Court is of the view to quash the order dated 31.01.2017.
5.In fine, this writ petition is allowed without costs and the impugned order dated 31.01.2017 passed by the first respondent is quashed. The respondents are directed to reconsider the representation alleged to have been given by the petitioner and pass suitable order.
