Conviction and sentence under Section 138 of the Negotiable Instruments Act are under challenge in this revision. Pending the proceedings, the parties settled the dispute amicably out of Court and compounded the offence. The composition was accepted and permission for composition was granted on Crl.M.A No.3580 of 2014. Accordingly, the conviction and sentence against the revision petitioner under Section 138 of the Negotiable Instruments Act in C.C No.171 of 2009 of the Judicial First Class Magistrate Court, Kalpetta are set aside and the revision petitioner is released from prosecution on the benefit of the acquittal under Section 320 (8) of Cr.P.C. The revision petition is allowed as above.
