This writ petition has been filed against the impugned order dated 23.02.2016 passed by the Joint Registrar of Co-operative Societies, Erode Region, bearing proceedings No.Na.Ka.1315/2016/Sa.Pa, dated 23.02.2016, refusing to entertain the statutory revision petition filed by the petitioner with a delay of 1899 days, against the order of demotion dated 04.10.2010.
2.Heard the learned counsel for the petitioner, the learned Government Advocate appearing for the 1st respondent and the learned Special Government Pleader appearing for the 2nd respondent.
3.The learned counsel for the petitioner would submit that after the petitioner was reverted from the post of Junior Assistant to the post of Salesman, the President of the Perundurai Agricultural Producers Co-operative Marketing Society (2nd respondent herein) warned the petitioner not to file any revision under Section 153 of Tamil Nadu Co-operative Societies Act, failing which he would be terminated from service. Only to safeguard his job and family, he was keeping quite and finally, he had to file the revision under Section 153 of Tamil Nadu Co-operative Societies Act before the 1st respondent, with a delay of 1899 days.
4.The said contention of the learned counsel for the petitioner cannot be taken for consideration, reason is that the President, who allegedly held threat of terminating the service of the petitioner, also demitted his office in the year 2013 itself. Having waited for the 2nd respondent to demit his office, the petitioner should have at least filed the revision immediately after his tenure expired. Though the 2nd respondent demitted his office in the year 2013, the petitioner has filed the revision petition only on 12.02.2016. Therefore, this Court is not inclined to entertain the writ petition as there is no merit in it.
In the result, the writ petition is dismissed. No costs.
