This writ petition has been filed by the petitioner, praying for a Writ of Mandamus, to direct the respondents to conduct the auction in respect of Survey No.179 in Velampatti Village, Dindigul District, transparently, in accordance with law.
2. The learned counsel for the petitioner had stated that the petitioner used to participate in the tender, public auctions conducted by the Natham Town Panchayat. During the year 2008-09, he had participated in the public auction to lease out the vegetable stalls in the market of the Natham Town Panchayat. The petitioner was a successful bidder for the Stall No.43 and the period of lease had come to an end on 31.03.2009. In the subsequent auctions, the petitioner was not succeeded. In such circumstances, the petitioner has filed the present writ petition before this Court to direct the respondents to conduct public auction in respect of Survey No.179, in Velampatti Village, Dindigul District, which is a vacant site meant to be used as a open market.

Mr.K.Balasubramanian, the learned Additional Government Pleader appearing on behalf of the respondents had submitted that there is no proposal by the respondents to conduct public auction in respect of Survey No.179 in Velampatti Village, at present. He had also submitted that as and when a decision is made by the respondent to conduct such an auction, it would be done in accordance with law.
4. In such circumstances, as no further orders are necessary in the present writ petition it stands closed, recording the submissions made by the learned Additional Government Pleader appearing on behalf of the respondents. No costs. Consequently, connected miscellaneous petition is also closed.
