JUDGMENT / ORDER

This contempt petition has been filed by the petitioner, praying that this Court may be pleased to punish the respondent for willful disobedience of the order passed by this Court, on 19.01.2009, in W.P.(MD) No.10509 of 2008.
2. At this stage of the hearing of the contempt petition, the learned Government Advocate appearing on behalf of the respondent had submitted that an order had been passed pursuant to the directions issued by this Court by its order, dated 19.01.2009. The learned Government Advocate had placed before this Court the copy of the order, dated 01.09.2009, issued by the Director of Municipal Administration, Chepauk, Chennai, which is as follows: "With reference to the Contempt Petition No.346 of 2009, in W.P.(MD) No.10509 of 2008 filed by you in the Hon'ble High Court of Madras, Madurai Branch, it is informed that since the departmental disciplinary action has been initiated against you in the reference 2nd cited (under the rule 8(2) of Tamil Nadu Municipal Services (Discipline and Appeal) Rules, 1970) and the same is pending, your suspension could not be revoked and you could not be permitted to retire from service on 30.06.2001 on attaining the age of superannuation."
3. In view of the order passed by the respondent, pursuant to the directions issued by this Court, this Court is of the view that no further orders are necessary. Hence, the contempt petition stands closed. No costs cs To Thiru. Dr.P.Senthil Kumar, The Commissioner of Municipal Administration, (Now redesignated as Director of Municipal Administration).
