JUDGMENT / ORDER

Petitioner’s property, situated in Survey No.173/1A of Kodakkal Village, is shown by the data bank as converted land. The petitioner approached this Court seeking a relief to correct the entries in the revenue records.
2. In 1989 a proceeding was initiated against him for reclamation of the land in contravention of the Land Utilisation Order. However, it is submitted that it was held in his favour. The petitioner submits that now the property is a dry land and unfit for any paddy cultivation or any other crops. There are many residential building in and around the property. Therefore, the property shall be classified as a dry land.
3. The fact that the property is not included as paddy land is not disputed in the counter. The Land Utilisation W.P.(C) No. 7471/2014 -2-
Order is under the Essential Commodities Act to secure the agricultural productivity. In the counter affidavit the revenue officials do not have a case that any of the agricultural crops are being cultivated in the property. The fact remains that this remain as a dry land.
4. Therefore, for all practical purposes, this property shall be treated as a dry land and petitioner shall be permitted to utilise the land for any purpose without obtaining any order. Accordingly, it is declared that the petitioner is entitled to use this land as dry land for all other purposes.
The Writ Petition is disposed of as above.
