JUDGMENT / ORDER

Petitioner is a registered dealer under the KVAT Act and CST Act. Against Ext.P1 assessment order for the year 2006-07 passed by the Assessing Authority, petitioner preferred Ext.P2 appeal and Ext.P3 stay petition before the 2nd respondent. While the stay petition is yet to be considered by the 2nd respondent, Ext.P4 revenue recovery notice has been issued by the 3rd respondent. Petitioner impugns Ext.P4 revenue recovery notice. 2. I have heard the learned counsel for the petitioner as also the learned Government Pleader.
2. In the facts and circumstances of the case, I am of the view that the writ petition itself can be disposed of with a direction to the 2nd respondent to consider and pass orders on Ext.P3 stay petition, after hearing the petitioner, within a period of one month from today.
W.P.(C).No.11838/2014 2 Until orders are passed on Ext.P3 stay petition and communicated to the petitioner, coercive steps pursuant to Ext.P4 shall be kept in abeyance.
Subject to the above direction, the writ petition is disposed of.
