M.Sevanthi vs Convenor

Madras High Court|11 September, 2017

JUDGMENT / ORDER

The prayer sought for in this writ petition is seeking for a mandamus to direct the respondent to consider the petitioner in scheduled caste category and consequently allot her M.B.B.S. seat in the reserved quota for scheduled caste.
2. Heard Mr.M.Gnansekar, the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondent.
3. The present writ petition seeking for a mandamus as stated supra itself came to be filed and listed before this Court for admission on 04.09.2017, much later to the last date for conducting counselling for M.B.B.S. course at Pondicherry Union Territory. Therefore, I find that the prayer sought for in this writ petition cannot be considered, at this stage. Accordingly, this writ petition is dismissed as infructuous, without expressing any view on the merits of the claim made by the petitioner with regard to her communal status as it is open to the petitioner to raise such claim at the appropriate time for the next academic year and if such claim is raised, the same shall have to be considered and decided on its own merits and in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
