Mr.V.Robinson vs The Secretary

Madras High Court|11 September, 2017

JUDGMENT / ORDER

The petitioner is aggrieved by the order passed by the 3rd respondent by which the petitioner's request to correct the spelling in his name as V.Robinson instead of V.Rabinson, which has been wrongly mentioned in the Secondary School Leaving Certificate Mark Sheet was rejected.
2. It is contended by the learned counsel for the petitioner that the correct spelling of the petitioner's name is V.Robinson whereas in SSLC Mark Sheet, it has been wrongly mentioned as V.Rabinson. Therefore, petitioner has approached the respondents seeking such correction. However, the 3rd respondent rejected the petitioner's claim relying upon Subsidiary Rule 5 of the SSLC scheme stating that request for alteration of name of the student would not be considered after the student completed the school course.
3. In this case, the petitioner has completed the course in the year 1999. Though, Rule 5 of the above scheme contemplates, no alteration of name can be made once the course is completed, a perusal of records especially the SSLC Mark Sheet issued for the examination conducted in October 2000, would reflect the correct name of the petitioner namely V.Robinson even though, the earlier Mark Sheets of the petitioner for the examination conducted in March 1999 and October 1999 reflect the wrong spelling namely V.Rabinson. Therefore, the respondents themselves at one point of time has given the correct name as V.Robinson.
4. In view of the above stated position, impugned order is liable to be quashed and accordingly, quashed. The respondents are directed to correct the spelling in the name of the petitioner, rightly N.KIRUBARAKAN,J tkp/sai as V.Robinson in all the certificates instead of V.Rabinson within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
