JUDGMENT / ORDER

The petitioner herein is the complainant in C.C.No.1156/2013 before the Judicial First Class Magistrate Court-I, Aluva. The offences involved are under sections 120(B), 406 and 420 IPC read with section 34 IPC. He has brought this proceeding under section 482 of the Cr.P.C. for a direction to the court below to expedite trial of the case and to dispose of it within a period fixed by this Court. It is submitted that the petitioner is a person suffering from so many ailments. He is a retired employee. He has lost a huge amount in the alleged transaction with the accused. He is confident, that if the case is tried and disposed of at the earliest, he will get the benefit of it, and he can collect the amount due, which can be utilised for his treatment.
2. The learned Judicial First Class Magistrate Court-I, Aluva submitted a report on 30.9.2014 as required by the Court. This report shows that the present pendency there is 16,566 and C.C.No.1156/2013 stands posted to 1.7.2015 for the personal Crl.M.C.No.5220 of 2014 2 appearance of the accused.
In such a situation, it would be inappropriate to direct the learned Magistrate to dispose of the case within a particular period. However, the grievance of the petitioner will have to be considered by the learned Magistrate, and all earnest efforts will have to be made to dispose of the case at the earliest. With these observations, this Crl.M.C. is closed. Communicate this order immediately to the court below.
