Mrs.Thulasiammal vs Mr.S.Shanmugasundaram

Madras High Court|31 January, 2017

JUDGMENT / ORDER

The first defendant in a suit for specific performance, has preferred this revision petition against the order refusing to receive Documents 1 to 4 in allowing partially to receive Documents 5 to 16, subject to proof and relevancy on payment of costs. Now, as against the portion that has been disallowed, the present revision petition is filed.
2. Documents 1 to 4 are the photocopies of the judgment and decree in O.S.No.699 of 1981 on the file of the Sub-Court, Coimbatore and the photocopies of the judgment in A.S.No.349 of 1995 and L.P.A.No.114 of 1998 on the file of this Court. When it is possible for the revision petitioner to obtain the certified copies of those documents, the petitioner cannot be permitted to mark the photocopies. Now, the learned counsel for the petitioner says that he would obtain the certified copies from the respective Courts and mark these documents, instead of marking the photocopies of the same. There cannot be any objection for marking the certified copies of the Court orders. Therefore, the petitioner is permitted to obtain the certified copies of Document Nos.1 to 4 from the concerned Courts and mark the same. The petitioner is directed to obtain the certified copies of those documents without wasting further time.
3. With the above direction, the Civil Revision Petition is disposed of. No costs. C.M.P. is closed.
