Mrs.M.S.Deiva Nayaki vs N.K.Suresh Kumar

Madras High Court|16 February, 2017

JUDGMENT / ORDER

The petitioners are the landlords and being the owners of the property, they have filed R.C.O.P.No.2 of 2015 on the file of XII Court of Small Causes, Chennai, seeking eviction of the respondent-tenant on the ground of additional accommodation. The respondent entered appearance before the Court below and R.C.O.P. stood posted for filing counter affidavit for many hearings. The respondent had filed one petition or the other against the revision petitioners/landlords, in which, the revision petitioners have filed counter affidavit and contested the cases. The fact remains that the respondent/tenant had not filed counter in the main R.C.O.P. and had been dragging on the proceedings. Hence, the petitioners have filed this revision seeking for early disposal of the main R.C.O.P. Taking into consideration the fact that the R.C.O.P. is being heard by the Court below for many hearings, but without any adjudication, this Court directs the learned XII Judge, Small Causes Court, Chennai to dispose of R.C.O.P.No.2 of 2015 before 30.06.2017. With this direction, the Civil Revision Petition is disposed of. No costs.
