Civil Misc. Substitution Application.
In the affidavit, it is stated that Smt. Pushpa Talwar, the sole petitioner expired on 18.5.2013 leaving behind her two legal heirs, stated in para 5, namely, Smt. Nandini Balraj, wife of Shri Balraj Wadhawan and Smt. Gayatri Malik, wife of Shri Rajeev Malik. No objection has been filed to the substitution application. The application is allowed. In front of the name of Smt. Pushpa Talwar, the word since deceased be mentioned and Smt. Nandini Balraj and Smt. Gayatri Malik be impleaded/substituted as petitioner nos. 1/1 and 1/2. Sri S.K. Rai, counsel for the Union of India, states that the property in dispute is the property of the old grant and Defence Estates Officer Lucknow Circle is the custodian and , therefore, he is the necessary party to be impleaded. Learned counsel for the petitioner is permitted to implead Defence Estates Officer Lucknow Circle as the respondent as the respondent no. 3 within 24 hours. Sri V.C. Rai, Advocate accepts notice on behalf of respondent no. 3. He prays for and is granted four weeks time to file counter affidavit. List in week commencing 10.11.2014.
