It is contended that the petitioner is working continuously as Seasonal Collection Peon since 2000 and that, his services were liable to be regularized in terms of the Rules of 2004 on account of 7th Amendment introduced in the Rules in 2017, but his services have not been regularized so far. Further grievance of the petitioner is that with effect from the month of April, 2018, the authorities have stopped taking work from him without passing any order. Various representations, made in that regard, have not been examined.
Learned standing counsel submits that all such grievance shall be examined by the authority concerned at the first instance.
In the facts and circumstances of the case, noticed above, this petition stands disposed of permitting the petitioner to represent his grievance before the respondent no. 2, along with certified copy of this order, within a period of two weeks from today. The petitioner shall be at liberty to annex all material in support of his claim. The authority concerned shall examine the claim of the petitioner for regularization in terms of 7th Amendment introduced in the Rules by passing a reasoned and specific order within a further period of three months thereafter. Petitioner's grievance, with regard to discontinuance from the month of April, 2018, shall also be addressed, in accordance with law, within the same period.
