M.Rithika (Minor) vs Dr.R.Narayanababu

Madras High Court|19 September, 2017

JUDGMENT / ORDER

This contempt petition is filed complaining that the respondents have willfully disobeyed with the interim order passed on 07.10.2016 in WP.No.34523 of 2016.
2. Heard both sides.
3. It is not in dispute that pursuant to the said interim order, the main writ petition itself was disposed of on 24.10.2016 and the said order passed in the main writ petition was put to challenge in WA.No.27 & 53 of 2017 wherein, the Division Bench of this Court passed an elaborate order on merits and disposed of WA.No.27 of 2017 and dismissed WA.No.53 of 2017. When such being the factual position and the interim order having got merged with the final order passed in the writ petition, which ultimately challenged in the writ appeals as stated supra, I do not think that the petitioner is entitled to maintain this contempt petition before this Court. Accordingly, this contempt petition is dismissed. It is for the petitioner to work out his remedy, if anything available under law and as per the order passed in the writ appeals before the appropriate forum.
