The prayer sought for in the present petition is to call for the records in C.C.No.2597 of 2017 on the file of the learned CCB/CBCID Metropolitan Magistrate, Allikulam/Egmore and quash the same.

Pending Criminal Original Petition, the petitioners and the second respondent/ defacto complainant have amicably resolved the dispute between themselves and accordingly, they have entered into a compromise and filed a Memorandum of Understanding dated 22.09.2017 and affidavit dated 16.11.2017 respectively.
3. Today, the petitioners as well as the second respondent/defacto complainant are personally present before this Court and they have also been identified. In order to identify themselves, the petitioners and the defacto complainant/second respondent have submitted the photo copies of their PAN Card, Voter ID, Driving Licence and Aadhar Card viz., 1. Ramayachitra PAN No:AKKPR4023Q; 2.Manoj Manji Patel - Voter ID No. MVL8453466; 3.Mehul Pathak-D.L. No.F/TN/004/003085/1999 and 4.G.Vellaichamy- Aadhar No.2437 0457 9728 and after verification of the original cards, the same are recorded.
4. An affidavit of the second respondent/defacto complainant dated 16.11.2017 is also filed to the effect that he has no objection to quash the proceedings in C.C.No.2597 of 2017 on the file of the learned CCB/CBCID Metropolitan Magistrate, Allikulam/Egmore.
5. Recording the same, the proceedings in C.C.No.2597 of 2017 on the file of the learned CCB/CBCID Metropolitan Magistrate, Allikulam/Egmore is quashed. The Criminal Original Petition is allowed.
6. The Memorandum of Understanding dated 22.09.2017 between the petitioner and the second respondent/defacto complainant and the affidavit filed by the second respondent/defacto complainant dated 16.11.2017 shall form part of the order.
