JUDGMENT / ORDER

This Writ Petition has been filed by the petitioner praying for issuance of a writ of Mandamus, directing the 2nd respondent to consider the petitioner's representation dated 24.06.2016 and to pass orders permitting the petitioner to let in both oral and documentary evidence.
2.Today, when the matter is taken up for consideration, the learned counsel for the 3rd respondent brought to the notice of this Court that the orders have already been passed by the 2nd respondent under Section 78 of the HR & CE Act on 13.01.2017 and the same was duly served to the petitioner on 20.01.2017; therefore, nothing survives in this writ petition; that if at all, the petitioner is aggrieved, he can challenge the said order dated 13.01.2017.
3.Recording the above submission made by the learned counsel for the 3rd respondent, this writ petition is dismissed. However, the petitioner is at liberty to challenge the order dated 13.01.2017 passed by the 2nd respondent, if he is so advised. No costs.
