1.Issue notice. Mr.C.Jagadish, learned Special Government Pleader, accepts notice on behalf of the respondents. With the consent of the counsels for the parties, the writ petition is taken up for hearing and final disposal.
2.The only limited direction that the petitioner seeks is that his matter be referred to the Special Committee for approval as per the provisions of the amended Rule 12 of the Tamil Nadu Minor Mineral Concession Rules, 1959.
3.The petitioner avers that he has obtained an Environmental Clearance Certificate. According to the petitioner, the Environmental Clearance Certificate was received on 23.10.2015.
4.In support of the relief sought in the present petition, counsel seeks to place reliance upon the orders passed by this Court in the following matters:
(i)order dated 17.08.2016, passed in W.P.No.28597 of 2016.
(ii)order dated 07.12.2016, passed in W.P.No.42734 of 2016.
5.Learned Special Government Pleader appearing for the respondents, says that the writ petition can be disposed of with a direction to the Special Committee to consider the case of the petitioner.
6.It is ordered accordingly. The Special Committee/ respondent no.2 will pass requisite directions, in accordance with law upon the District Collector/ respondent no.1 referring the matter to the Special Committee. Latter will be done by the District Collector/respondent No.1 with due expedition.
7.The writ petition is ordered accordingly. No costs.
