The petitioner has approached this Court aggrieved by Ext.P3 order issued by the first respondent-Revenue Divisional Officer Palakkad directing the petitioner to remove the fence put up by him across his property by using barbed wire. Feeling aggrieved by this, the petitioner filed this writ petition. If the barbed fence put up by the petitioner is causing obstructions to the public path, final order directing removal of such fence cannot be passed by the respondents without considering objections from the petitioner. Therefore, Ext.P3 can be treated as a provisional order. The petitioner submitted that he has raised Ext.P4 objection. 2. In view of the above, there shall be a direction to the first respondent-Revenue Divisional Officer to pass final orders after adverting to Ext.P4 objection, after hearing the petitioner and also other affected parties within a period of three weeks W.P.(C) No.29846/2014 2 from the date of receipt of a copy of this judgment. Till the final decision is taken, no action shall be taken against the petitioner pursuant to Ext.P3.
The writ petition is disposed of with the above directions.
