JUDGMENT / ORDER

The court below has thought it fit to issue notice to the defendant on the application for issuing a Commission. Whether an Advocate Commissioner has to be deputed or not would be considered after notice to the parties. The discretion exercised by the Court below in issuing notice cannot be tinkered with in this supervisory jurisdiction.
The Original Petition fails and is dismissed.
