The petitioner is seeking for a direction to the first respondent for having an expeditious disposal of Ext.P2 appeal pending before the said respondent. The same is dated 23/02/2011.
2. The petitioner is having certain items of properties described in para.1 of the writ petition. It is also stated that mutation was effected and he was paying tax till 1999. It appears that he is residing 70 kms away from the said property and therefore, he could not remit the tax for the succeeding periods. He filed an application before the second respondent for remitting tax which was rejected against which he filed an appeal as per Ext.P2 before the first respondent.
3. There will be a direction to the first respondent to take a decision on Ext.P2 appeal after hearing the petitioner within a period of three months from the date of production of a certified copy of this Judgment.
4. Learned counsel for the petitioner then submitted that a proper survey will have to be conducted.
5. This is a matter which the District Collector will have to consider and if the same is required, appropriate directions will be issued in that regard also. The petitioner will forward a copy of the writ petition along W.P.(C). No.24469/2012 -:2:- with the certified copy of the Judgment to the first respondent for compliance. The writ petition is disposed of as above. No costs.
