JUDGMENT / ORDER

The petitioner has filed Crl.OP No. 29092 of 2015 praying to transfer the investigation in Crime No. 1758 of 2011 on the file of the Inspector of Police, V-5 Thirumangalam Police Station to Central Crime Branch at Chennai. This Court, after hearing the counsel for both sides, disposed of the Criminal Original Petition by the order dated 04.01.2016 directing the Commissioner of Police, Chennai to transfer the investigation in Crime No. 1758 of 2011 to the Deputy Commissioner, Central Crime Branch, Chennai within a period of one month from the date of receipt of the order and the Deputy Commissioner of Police, Central Crime Branch, Chennai was directed to nominate a Inspector of Police to investigate into the complaint of the petitioner and to proceed further in accordance with law. Since the respondents did not comply with the order dated 04.11.2016 passed by this Court, the petitioner has come forward with this contempt petition.

When the Contempt petition is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents brought to the notice of this Court that in compliance with the directions of this Court, the investigation into the case in Crime No. 1758 of 2011 was entrusted with Mr. Janakiraman, Inspector of Police, who, after investigation, has filed the final report before the III Metropolitan Magistrate Court, Egmore, referring the complaint given by the petitioner as a 'mistake of fact'.
3. In the light of the above submission of the learned Additional Public Prosecutor appearing for the respondents, this Court is of the view that no further order is required to be passed in this Contempt Petition. Accordingly, the contempt petition is closed. No costs. It is needless to state that it is open to the petitioner to proceed further in accordance with law, if he is aggrieved by the final report filed by the investigation officer, referring the complaint given by him as a mistake of fact.
