Mr. Dinesh Narain Seth [U/A 227] vs Addl. Civil Judge Ist (Senior ...

High Court Of Judicature at Allahabad|27 March, 2014

JUDGMENT / ORDER

Notice on behalf of opposite party no.1 has been accepted by the learned Chief Standing Counsel.
In view of the order proposed, issuance of notice to opposite party nos. 2 to 16, is hereby dispensed with.
By means of present writ petition, the petitioner is seeking a writ in the nature of mandamus for directing the learned Additional Civil Judge, 1st (Senior Division), Court No.20, Lucknow to decide the Regular Suit No. 289 of 1997 (Pratap Narain Seth and others vs. Malti Seth and others), pending in the Court of opposite party no.2, within a time frame fixed by this Court.
On a query being made by the Court to the learned counsel for petitioner as to what is the stage of the suit, the learned counsel for petitioner submitted that though the suit pertains to the year 1997 but till date no evidence has been adduced by either of the parties, therefore, the petitioner is constrained to approach this Court by filing the instant writ petition for early disposal of the aforesaid suit.
On due consideration, this Court feels that the suit is not ripe for hearing and at this stage, no direction can be issued to the trial court for early disposal of the suit out of tern. No good ground for interference, in the instant writ petition, is made out.
The petition, being misconceived, is hereby dismissed.
