Heard learned counsel for the petitioners, learned A.G.A. and Sri Shailendra Kumar Singh, learned counsel for the complainant.
This petition has been filed by the petitioners Mr. Amit Singla & Others with a prayer to quash the FIR of case crime No. 2539 of 2013 under section 395 IPC, P.S. Gangaghat, District Unnao From the perusal of the FIR it appears that on the basis of allegation made therein the prima facie cognizable offence is made out. There is no scope of interfering in the FIR. Therefore, the prayer for quashing the FIR is refused.
However, considering the nature of the allegation and interim order dated 29.10.2013 the arrest of the petitioners have been stated till the next date of listing, it is directed that petitioners shall not be arrested till the submission of the police report under section 173(2) Cr.P.C. but the petitioners shall cooperate with the investigation.
With this direction, this petition is finally disposed of.
