… RESPONDENT (BY SRI VIJAY KUMAR A PATIL, AGA) THESE WRIT PETITIONS ARE FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO CALL FOR THE RECORDS PERTAINING TO THE IMPUGNED TENDER NOTIFICATION DATED 13.02.2019 AT ANNEXURE-A AND ETC.
THESE PETITIONS COMING ON FOR PRELIMINARY HEARING, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Smt. Bharathi.M, learned counsel for Sri.Venkatesh R. Bhagat, learned counsel for the petitioners.
Sri.Vijay Kumar A. Patil, learned counsel for the respondent.
The petitions are admitted for hearing. With consent of the learned counsel for the parties, the same is heard finally.
2. In these petitions, the petitioners inter alia have prayed for the following reliefs:
“a) Call for the records pertaining to the impugned Tender Notification bearing No.SWD:ED4:CR-11/2018-19 dated 13/02/2019 at Annexure-A;
b) Issue a writ of certiorari or any other writ quashing the impugned Tender Notification at No.SWD:ED4:CR- 11/2018-19 dated 13/02/2019 at Annexure-A issued by the Respondent;
c) Pass such other order or directions as this Hon’ble Court deems fit in the interest of justice and equity.”
3. When the matter was taken up today, learned counsel for the petitioners submitted that even though a period of seven days was mentioned in the tender notification, yet, the petitioner including seven more bidders have submitted their bids.
4. In view of the aforesaid submission and taking into account the fact that the petitioner has submitted its bid within the time prescribed in the tender notification, nothing survives for adjudication in these writ petitions. Accordingly, the writ petitions are disposed of.
