Heard learned counsel for the petitioners and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus directing the respondent no.1 to decide the case no. 827 of 2016 (Yusuf Khan Vs. Shamim Khan) under Section 9A (2) of the Consolidation Holding Act, 1953.
The contention of learned counsel for the petitioners is that respondents filed the said objection under Section 9A (2) of the U.P.C.H. Act, which is pending since 2006. It is further contended that respondent no.2 has adopted tactics in order to keep the objection pending and order sheet in support thereof has been filed.
Under these circumstances, respondent no.1- Consolidation Officer, Bahjoee, Region Chandausi, District Sambhal is directed to decide the case no. 827 of 2016 (Yusuf Khan Vs. Shamim Khan) expeditiously preferably within a period of six months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
