Respondent/ Complainant Petition under section 438 of Cr.PC., praying that in the circumstances stated in the memo of grounds filed herein the High Court may be pleased to enlarge the petitioners on bail in the event of their arrest in connection with the F.I.R.No. 14 of 2014 on the file of the Judicial First Class magistrate, Alampur which was referred Rajoli Police Station, Wadepalli Mandal, Mahaboobnagar District pending investigation.
The petition coming on for hearing, upon perusing the Petition and the memo of grounds filed herein, and upon hearing the arguments of Sri A. Raghavaiah, Advocate for the Petitioner, and of Public Prosecutor for Respondent, the Court made the following.
ORDER:
Petitioners are A1, A3 and A4. They allegedly committed offences under Sections 448, 323, 452, 504, 506, 354 and 384 read with Section 34 IPC. A private complaint was lodged by one V. Vijaya Durga, which was referred to by the Court to Police, Whereupon, Crime No.
14 of 2014 was registered by the Police against the petitioners.
The learned counsel for the petitioners submitted that a private complaint by V. Vijaya Durga was a counter blast to the complaint lodged by the petitioners ..2..
against V. Vijaya Durga and others. He also pointed out that A2, A5 and A6 were already granted anticipatory bail by me through orders in Crl.P.No. 3052 of 2014. The petitioners herein stand on the same footing as accused Nos. 2, 5 and 6. Added to it, it is the contention of the learned counsel for the petitioners that this case is a counter blast to the complaint lodged by the petitioners. I, therefore, consider it appropriate to enlarge the petitioners on anticipatory bail.
Consequently, this Criminal Petition is allowed. The petitioners shall surrender before the learned Judicial Magistrate of First Class, Alampur, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Alampur shall enlarge the petitioners on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties each in a likesum to his satisfaction.
