Heard learned counsel for the petitioners, learned AGA and perused the record.
The present habeas corpus petition is being filed by Moushree, mother of petitioner no. 2, Smt. Sarita Devi.
Submission made by the counsel for the petitioners that Ms. Sarita Devi is married to respondent no. 2. This was an arrange marriage. It is further submitted that Ms. Sarita Devi was missing since December, 2019. It was given to understand that she was taken away by respondent no. 5 Banudher Bareek to Orissa. The victim remained in the company of respondent no. 5 for a period of 8-9 months. Today, she has brought before the Court and duly identified by Sri Binod Kumar Vishwakarma, learned counsel for the petitioners and on making inquiry by the Court, Ms. Sarita Devi states that she was forcibly taken away by respondent no. 5 and she was remained in his company against her wish and desire. Today, she has brought before the Court and she reveals that she is married to Satish S/o Ramsewak (respondent no. 4). After narrating the said story of her kidnapping, she in no uncertain terms states that she wants to go with her husband Satish. Since, she is a married lady and have got every right to decide her future, being a married woman she is set free to join the company of her husband ad per her wish and plan.
With this observation, the present habeas corpus petition stands disposed of.
