However, in view of G.O.Ms.No.24, Revenue (Excise-II) Department, dated 04.09.2014, certain provisions relating to the prohibition of 50 kms., between two shops has since been relaxed and thereby, petitioner states that he is eligible to get a licence for running a toddy shop. Respondent No.3 further asked the petitioner for submission of registration certificate of the Society, registered bye-laws, Audit Certificates, Membership identity cards and others records, if any. To that extent, however, petitioner states that they have requested time for submission of the rest of the documents and later the documents were furnished along with a letter on 10.11.2014. Petitioner, however, states that in spite of submission of all the documents, the request of the petitioner is not being considered so far. Hence, the present writ petition.
3. Learned Assistant Government Pleader states that the Prohibition and Excise Superintendent would consider the petitioner’s application along with the documents and pass appropriate orders expeditiously.
In view of that, the writ petition is disposed of directing respondent No.3 to consider petitioner’s request in the light of the documents submitted by him, in accordance with the policy guidelines and law, and pass appropriate orders thereon expeditiously preferably within four weeks from the date of receipt of a copy of this order.
