JUDGMENT / ORDER

Hon'ble Devendra Kumar Arora,J.
The petitioner files an affidavit of service on opposite party no. 5 who has refused to accept the same. Notice on behalf of opposite parties no. 1 to 4 has been accepted by learned Chief Standing Counsel. The petitioner has challenged the auction of fisheries right, finalized in favour of the opposite party no. 5 on 31.05.2010 on the ground that by means of earlier order dated 15.05.2010 the same has been granted to the petitioner and he also started fisheries operation but without canceling the same as well as without fresh notice of auction it has been granted to opposite party no. 5. We are informed that the fisheries operation has to complete before rainy season, therefore, instead of keeping the writ petition pending, we hereby disposed of the same with the direction to the District Magistrate, Sitapur to determine the right of the parties within three days' from the date of receipt of certified copy of this order and to act upon accordingly.
