Mottavila Sreebhadrakali ... vs K.N.Suseelan

High Court Of Kerala|17 July, 2000

JUDGMENT / ORDER

The petitioners contend that they sought to be dispossessed in execution of a decree to which they are not parties. The petitioners also point out that they have already filed a suit in this regard as O.S.No.740 of 2011 on the file of the court of the Subordinate Judge of Thiruvananthapuram.
2. The petitioners can either file an appeal from the impugned order rejecting their 'obstruction petition' numbered as E.A.No.785 of 2011 in E.P.No.118 of 2000 in O.S.No.110 of 1958 or seek injunctive reliefs in O.S.No.740 of 2011 pending.
3. The present original petition under Article 227 of the Constitution of India is misconceived and is hence dismissed. The order impugned shall not be implemented for a period of three days to enable the petitioners to work out their remedies as above.
V.CHITAMBARESH, Judge.
